HB 1258 Juvenile offenders; transfer for trial as adult.

Introduced by: James K. O'Brien, Jr. | all patrons    ...    notes | add to my profiles

SUMMARY:

Juvenile offenders; transfer for trial as adult. Provides that juveniles 14 or older and charged with specified violent felonies (i.e., those felonies for which a juvenile 14 or older may currently be transferred without necessity of an appropriateness determination) are to be tried and sentenced in the circuit court as adults. The juvenile court is divested of jurisdiction over these individuals. No transfer hearing is required in the juvenile court for juveniles 14 and older and charged with those specified felonies; the circuit court, if the juvenile notes an appeal, is to hold a hearing and determine the appropriateness of the transfer. Juveniles 14 or older who are transferred and tried are, if convicted of a violent felony, to be sentenced as adults.
