SUMMARY:
Dismissal of action by nonsuit. Changes the Virginia Supreme Court's interpretation of the statute in McManama v. Plunk, 250 Va. 72 (June 1995) by clearly specifying that a party is entitled to take a nonsuit only within one year of the commencement of the action if no process has been served. The Virginia Supreme Court held in McManama that a party could take a nonsuit after one year if service had not been made on a party.
