SUMMARY:
Remediated property fresh start program. Provides persons that acquire interests in "superfund" National Priorities List property that has undergone a remediation (clean-up) acceptable to the United States Environmental Protection Agency immunity from enforcement and remediation actions under the state's water, air and waste laws and from citizen suits related to the contamination that was the subject of the remediation. The same limitations on liability are afforded to subsequent property interest holders. A person will not have immunity if the person alters the remediation. Persons that held an interest in the property prior to the property being acquired by a person entitled to immunity are not eligible for immunity.
