SUMMARY:
Judicial authorization for mental or physical health treatment. Amends provision authorizing court-ordered antipsychotic medication or electroconvulsive therapy over a person's objection only if he is subject to an involuntary commitment order under § 37.1-67.3 or has been determined incompetent to stand trial pursuant to Chapter 11 of Title 19. In 1991, Code provisions governing proceedings on questions of insanity and evaluation and treatment of insanity acquittees (not guilty by reason of insanity) were amended and divided into two chapters, Chapter 11 and Chapter 11.1. of Title 19.2. At that time, § 37.1-134.5 was amended to include Chapter 11 of Title 19 but inadvertently did not include a reference to the new Chapter 11.1 (insanity acquittees). This bill corrects that inadvertent omission.
