Introduced by: Robert E. Nelms | all patrons    ...    notes | add to my profiles

SUMMARY:

Wetlands mitigation banking. Allows those who are required to conduct compensatory mitigation for adverse impacts to wetlands to satisfy the requirement by purchasing mitigation credits from a wetlands mitigation bank that has been approved and is operating in accord with applicable federal guidance for the establishment, use and operation of mitigation banks. Conditions on the use of such a bank include: (i) it is in the same U.S.G.S. cataloging unit, or an adjacent unit within the same river watershed, as the impacted site; (ii) the bank is ecologically preferable to practicable on-site and off-site individual mitigation options, as defined by federal wetland regulations; and (iii) the banking instrument has been approved by a process that included public review and comment.
