SUMMARY:

Pledge of Allegiance in public schools. Directs the Board of Education, in consultation with the Office of the Attorney General, to develop guidelines on constitutional rights and restrictions regarding the Pledge of Allegiance to the American flag in the public schools. The Board's guidelines are to include provisions addressing initiative and involvement of local school boards, schools, administrators, teachers, and students; the propriety of any recitation or participation requirements; and relevant state and federal constitutional concerns, such as freedom of speech. Although these guidelines will be exempt from the Administrative Process Act, the Board is required to hold public hearings, provide notice to relevant parties of such hearings, and allow opportunity for public involvement in the development of the guidelines. This bill is identical to HB 433.
