SUMMARY:

Delay of mandatory parole by Parole Board Chairman. Allows the Parole Board to delay the release of a prisoner about to be released on mandatory (six-months prior to scheduled release date) parole if, at any time prior to release, information is given to the Board which gives the Board reason to believe the release presents a risk to public safety and allows the Chairman (or other member, if the Chairman is unavailable) to make such a determination and decision alone if there is insufficient time to have the matter reviewed by the entire Board. The bill provides for referral of the decision to delay release to appropriate authorities and review by the Board of the decision to delay release.

Currently, only the Board can act to delay release, and current law limits such decisions to those made upon new information which is received within 30 days of the pending release and which gives the Board reasonable cause to believe that the person's release poses a clear and present danger to the life or physical safety of any person.
