961198204Be it enacted by the General Assembly of Virginia:
1. That the Code of Virginia is amended by adding in Chapter 1 of Title 4.1 a section numbered 4.1-133 as follows:
§ 4.1-133. Title to beverages to pass upon possession; bailment system of warehousing prohibited.
Notwithstanding any other provision of this title, the Board shall assume ownership and legal title to alcoholic beverages purchased or ordered by it and delivered to any warehouse or government store operated by the Board at such time as the Board or its agent obtains physical possession of such beverages.
The Board shall not adopt any regulation or policy (i) establishing bailment warehousing operations or (ii) requiring a vendor of alcoholic beverages to retain ownership or legal title to such beverages purchased or ordered by the Board for any period after the Board or its agent comes into physical possession of such beverages.
