WHEREAS, the Code of Virginia contains numerous statutes validating, after the passage of time, certain documents or acts, the legal effect of which might otherwise have been questioned due to noncompliance with technical legal requirements; and

WHEREAS, many of such validation statutes have not been updated in recent years, although in most if not all cases there is a need for updating such statutes; and

WHEREAS, the Virginia Bar Association has expressed a willingness to assist in the process of updating validation statutes that are in need of updating; now, therefore, be it

RESOLVED by the House of Delegates, the Senate concurring, That the Virginia Bar Association study the need for and appropriateness of updates to validation statutes contained in the Code of Virginia; and, be it

RESOLVED FURTHER, That the Division of Legislative Services assist the Virginia Bar Association in this study by identifying all validation statutes currently contained in the Code of Virginia and reporting its findings to the Virginia Bar Association at least ninety days prior to the commencement of the 1997 Session of the General Assembly.

The Virginia Bar Association shall complete its work in time to submit its findings and recommendations to the Governor and the 1997 Session of the General Assembly as provided in the procedures of the Division of Legislative Automated Systems for processing legislative documents.
