Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding a section numbered 32.1-112.2 as follows:

§32.1-112.2. State Office of Emergency Medical Services director appointed; powers and duties.

A. Effective on and after July 1, 1996, the Governor shall appoint a Director of the State Office of Emergency Medical Services, after receiving the nominations or recommendations of the State Emergency Medical Services Advisory Board, subject to confirmation by the General Assembly. The Director shall hold his position at the pleasure of the Governor.

B. The Director shall have the following powers:

1. To supervise the administration of work of the Office;

2. To prepare, approve, and submit any requests for appropriations to the State Board of Health, upon review and approval of the Commissioner of Health and the State Emergency Medical Services Advisory Board;

3. To be responsible for all expenditures pursuant to appropriations;

4. To employ such staff as is necessary to carry out the powers and duties of this chapter, within the limits of available appropriations;

5. To do all acts necessary or convenient to carry out the purpose of this article and assist the Board, the Commissioner, the Advisory Board, and the regional emergency medical services councils in carrying out their responsibilities and duties for the administration of the statewide emergency medical services system and the implementation of the Statewide Emergency Medical Services Plan;

6. To make and enter into all contracts and agreements necessary or incidental to the performance of its duties and the execution of its powers under this article, including, but not limited to, contracts with the United States, other states, and agencies and governmental subdivisions of the Commonwealth. If the Director contracts with an organization for services as necessary to provide for the training and certification of emergency medical services personnel, ensure the adequacy of emergency medical services vehicles to meet service delivery needs throughout the Commonwealth, or to conduct the technical analyses of all aspects of the emergency medical services system under this article, he may only do so upon receiving the prior approval of the Board or the Commissioner to contract with that organization.
