965379400Be it enacted by the General Assembly of Virginia:
1. That the Code of Virginia is amended by adding in Article 2 of Chapter 4 of Title 2.1 a section numbered 2.1-37.02 as follows:
§ 2.1-37.02. Prohibition against holding two elected offices simultaneously; further exceptions.
Notwithstanding the provisions of § 2.1-37.01, it shall be permissible for a mayor or council member of a town to be elected to the school board of the county in which the town is located and to hold both offices simultaneously. This section shall apply only if the mayor or council member served simultaneously as mayor or council member and as an appointed member of the county school board, pursuant to the authorization of subdivision A12 of § 22.1-30, at the time of his election to the school board.
This section shall be applicable to elections to the school board held in 1995 and years thereafter.
2. That an emergency exists and this act is in force from its passage.
