Whereas, Ronald L. McKinney on March 18, 1981, while making a night deposit at a local bank for his employer, was shot several times during a robbery attempt; and

Whereas, upon his return to work, he was unable to work more than twenty-five hours a week at light duty; and

Whereas, it was only upon the expiration of the statute of limitations that Mr. McKinney was diagnosed as suffering from post-traumatic stress syndrome; and

Whereas, upon the sale of his employer's business in May 1984, Mr. McKinney was unable to find comparable part-time, light-duty work; and

Whereas, the then Industrial Commission denied his claim for workers' compensation as time-barred; and

Whereas, during its 1985 Session, the General Assembly addressed the situation Mr. McKinney faced by enacting § 65.1-87.1 (now § 65.2-602) which tolls the statute of limitations; and

Whereas, such legislation was not made retroactively effective, and Mr. McKinney, whose plight demonstrated the need for the General Assembly to act, received no benefit from its enactment; and

Whereas, Mr. McKinney has no other means to obtain relief except by action of this body; now, therefore,

Be it enacted by the General Assembly of Virginia:

1. § 1. That there is hereby appropriated from the general fund of the state treasury the sum of $20,000 for the relief of Ronald L. McKinney. This sum shall be paid by check issued by the State Treasurer on a warrant issued by the Comptroller, upon execution by Ronald L. McKinney of a release of all claims he may have against the Commonwealth or any of its political subdivisions or their officers, employees, or agents.
