Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding a section numbered 46.2-1224.1 as follows:

§ 46.2-1224.1. Local ordinances regulating certain parking; penalty.

The governing body of any county, city, or town may by ordinance prohibit allowing the engine of a commercial motor vehicle to remain in operation for more than three minutes when the vehicle is parked, left unattended, or is stopped for other than traffic or maintenance reasons, except when the engine is being used to provide power for a vehicle auxiliary system other than heating or air conditioning. Violations of any such ordinance shall be punishable by a fine of no more than fifty dollars.
