Be it enacted by the General Assembly of Virginia:

1. That § 10.01 of Chapter 717 of the Acts of Assembly of 1980 is amended and reenacted [ and that Chapter 717 is amended by adding a section numbered 14.06 ] as follows:

§ 10.01. Composition and functions.

A. Composition. The department of education shall consist of the city school board, the superintendent of schools, and the employees thereof. The city school board and the superintendent of schools shall exercise all the powers conferred and perform all the duties imposed upon them by general law.

B. School board. The school board shall be composed of nine members who shall be appointed by the council for terms of three years. No person shall be appointed to the school board for more than three consecutive terms. Vacancies shall be filled by the council for any unexpired term elected at large for terms of four years in the manner prescribed by general law. Vacancies shall be filled in accordance with §§ 24.2-226 and 24.2-227 of the Code of Virginia, 1950, as amended.

C. School superintendent. The school board shall appoint a school superintendent who shall be chosen on the basis of general executive and administrative ability, education, training and experience in the field of education in the manner provided by general law.

[ § 14.06. City exempt from certain fees.

The City shall be exempt from the payment of all Chesapeake sheriff's fees required by general law for service and processing of documents in all courts. ]
