HOUSE BILL NO. 1297 AMENDMENT IN THE NATURE OF A SUBSTITUTE (Proposed by the Senate Committee on General Laws on February 28, 1996) (Patron Prior to Substitute--Delegate McEachin) A BILL relating to powers of the City of Richmond.

Be it enacted by the General Assembly of Virginia:

1. § 1. Notwithstanding any contrary provision of law, general or special, the City of Richmond may sell all or any portion of Shockoe, Oakwood, Maury, Mt. Olivet, or Riverview cemeteries, but only after adequate provisions are made in any such contract of sale for (i) the perpetual care of such cemetery or portion thereof and all graves and entombment rights therein and (ii) the burial of indigent persons.

§ 2. Notwithstanding any contrary provision of law, general or special, the City of Richmond, whenever required to publish a notice, may cause such notice to be published in any newspaper of general circulation in the city.

§ 3. That the Department of Historic Resources, in conjunction with the City of Richmond, is requested to study the maintenance and upkeep of the city's cemeteries; to identify the number of grave sites in each city-owned cemetery in need of restoration; and to quantify the funds required for such maintenance, upkeep, and restoration. The study shall also identify the location and number of historic graves, including, but not limited to those of Revolutionary and Civil War soldiers and those which may be eligible for funds pursuant to § 10.1-2211. The Department shall submit its findings and recommendations to the Governor and the 1997 Session of the General Assembly as provided in the procedures of the Division of Legislative Automated Systems for the processing of legislative documents.

§ 4. That the provisions of § 1 of this act shall become effective on July 1, 1997.
