An Act to amend and reenact §§ 48-5 and 48-11 of the Code of Virginia, relating to fines for nuisances.

Be it enacted by the General Assembly of Virginia:

1. That §§ 48-5 and 48-11 of the Code of Virginia are amended and reenacted as follows:

§ 48-5. Fine and costs; judgment of abatement.

Upon the trial of any such presentment the person or persons who have created, caused or permitted the continuation of such nuisance, if found guilty, shall be fined, in the discretion of the jury, not more than $5,000 $10,000; and upon such verdict the judgment of the court shall be for the amount of fine imposed and the costs of such proceeding, and also that such nuisance be forthwith removed and abated.

§ 48-11. Punishment for contempt.

A party found guilty of contempt under the provisions of § 48-10, shall be punished by a fine of not less than $100 nor more than $1,000 $2,500, or by imprisonment in jail not less than three months nor more than six months, or in the discretion of the court by both fine and imprisonment.
