1996 SESSION
Be it enacted by the General Assembly of Virginia:
1. That § 45.1-256 of the Code of Virginia is amended and reenacted as follows:
§ 45.1-256. Training and certification of blasters.
A. 1. In order to ensure that explosives are used only in accordance
with applicable state and federal laws, the Director is authorized to
promulgate regulations requiring the training, examination and certification of
persons engaging in or directly responsible for blasting or the use, storage
and handling of explosives in coal surface mining operations.
2. Upon request of the Director, the Commissioner of Labor and Industry may
delegate the Chief of the Division of Mines or his authorized representative to
participate, in conjunction with the Division, in a joint effort for training
and certifying blasters in the Commonwealth.
B. The Division shall assume primary responsibility for conducting the
examinations and issuing the certificates for such persons in accordance with
the regulations adopted pursuant to subdivision A 1 of this section.
