An Act for the relief of Harvey L. Worley and Betty A. Worley.

Whereas, on January 24, 1992, Harvey L. Worley and Betty A. Worley purchased a parcel of land purported to contain 13 acres in the Blue Ridge Magisterial District of Franklin County at a Franklin County escheat sale; and

Whereas, following completion of a survey and examination of the land records of Franklin County, Harvey L. Worley and Betty A. Worley were advised that the parcel which they had purchased did not exist as described on the tax map and, therefore, had been improperly escheated to the Commonwealth; and

Whereas, upon learning of this information, Harvey L. Worley and Betty A. Worley submitted a claim for refund of their payment of $3,250 for the parcel in accordance with subsection A of § 55-200 of the Code of Virginia; and

Whereas, the claim for a refund filed by Harvey L. Worley and Betty A. Worley was denied because discovery and submittal of the claim was made beyond the 120-day refund period allowed pursuant to § 55-200 A of the Code of Virginia; and

Whereas, Harvey L. Worley and Betty A. Worley have no other means to recover the expenses they incurred as a result of the improper escheat sale except by action of this body; now, therefore,

Be it enacted by the General Assembly of Virginia:

1. § 1. That there is hereby appropriated from the general fund of the state treasury the sum of $2,593.03. This payment shall be for the relief of Harvey L. Worley and Betty A. Worley to be paid by check issued by the State Treasurer on warrant of the Comptroller to Harvey L. Worley and Betty A. Worley, upon a release by them of all claims against the Commonwealth and its political subdivisions, agencies, instrumentalities, officers, or employees arising out of the aforesaid occurrence, provided that Harvey L. Worley and Betty A. Worley return the original grant to the State Treasurer, who shall note its return in the records of his office, and provided further that Harvey L. Worley and Betty A. Worley execute and record a quit claim deed to the Commonwealth of Virginia and return the quit claim deed to the Treasurer.
