CHAPTER 387
An Act to amend and reenact § 10.01 of Chapter 717 of the Acts of Assembly of 1980, which provided a charter for the City of Chesapeake, relating to the city school board.

Be it enacted by the General Assembly of Virginia:

1. That § 10.01 of Chapter 717 of the Acts of Assembly of 1980 is amended and reenacted as follows:

§ 10.01. Composition and functions.

A. Composition. The department of education shall consist of the city school board, the superintendent of schools, and the employees thereof. The city school board and the superintendent of schools shall exercise all the powers conferred and perform all the duties imposed upon them by general law.

B. School board. The school board shall be composed of nine members who shall be appointed elected at large by the council for terms of three four years in the manner prescribed by general law. No person shall be appointed to the school board for more than three consecutive terms. Vacancies shall be filled by the council for any unexpired term in the same manner in which general law provides for the filling of vacancies of city council members pursuant to §§ 24.2-226 and 24.2-228 of the Code of Virginia with the interim appointment to be made by a majority vote of the remaining members of the board.

C. School superintendent. The school board shall appoint a school superintendent who shall be chosen on the basis of general executive and administrative ability, education, training and experience in the field of education in the manner provided by general law.
