An Act to amend and reenact § 15.1-18.3 of the Code of Virginia, relating to powers of service districts.

Be it enacted by the General Assembly of Virginia:

1. That § 15.1-18.3 of the Code of Virginia is amended and reenacted as follows:

§ 15.1-18.3. Service districts in counties, cities and towns.

The governing body of any county, city, or town, by duly adopted ordinance in accordance with the notice and hearing provisions of § 15.1-18.2, may create service districts for the purposes set forth in subsection A of § 15.1-18.2, or may create authorities for the purposes set forth in subsection B of § 15.1-1241 if authorized by that subsection provided that the creation of such authority is undertaken in conformity with the requirements of Chapter 28 (§ 15.1-1239 et seq.) of Title 15.1 including the requirement of a petition from landowners, except as to the members of the development authority, who shall be appointed pursuant to § 15.1-1249 and not subsection B 5 of § 15.1-1241, and may exercise any or all of the powers with respect to such service districts set forth in subsection C of § 15.1-18.2. In addition, the governing body may contract with any state agency or state or local authority for services within the power of the agency or authority related to the financing, construction or operation of the facilities and services to be provided within the district; however, nothing herein shall authorize a county, city or town to obligate its general tax revenues, or to pledge its full faith and credit.

The ordinance for the district shall:

1. Set forth the name and describe the boundaries of the proposed district and any areas within the district that are to be excluded;

2. Describe the facilities and services proposed within the district;

3. Describe a proposed plan for providing such facilities and services within the district; and

4. Describe the benefits which can be expected from the provision of such facilities and services within the district.
