An Act to amend and reenact § 9-145.51 of the Code of Virginia, relating to the Virginia Technology Council.

Be it enacted by the General Assembly of Virginia:

1. That § 9-145.51 of the Code of Virginia is amended and reenacted as follows:

§ 9-145.51. Membership; terms; chairman and vice chairman; staff.

A. The Council shall be composed of the following eighteen members: one member of the House of Delegates to be appointed by the Speaker of the House of Delegates, one member of the Senate to be appointed by the Senate Committee on Privileges and Elections, the Secretary of Commerce and Trade, the Secretary of Administration, the President of the Center for Innovative Technology, and a representative of the Virginia Chamber of Commerce. After consultation with the regional technology councils and regional Chambers chambers of Commerce commerce, the Governor shall appoint twelve members representing the geographic diversity of the Commonwealth.

The member of the House of Delegates shall be appointed by the Speaker of the House of Delegates for a term of two years and the member of the Senate by the Senate Committee on Privileges and Elections for a term of four years. Legislators' terms shall be concurrent with their elected terms of office, provided that the terms of such members shall terminate in the event they no longer are members of their respective houses. Appointments to fill legislative vacancies shall be for the unexpired term and shall be made in the same manner as the original appointment.

B. The Council shall elect a chairman and a vice chairman from among its members and develop bylaws that govern the terms served by the nonlegislative members.

C. Staff support for the Council shall be provided by the Center for Innovative Technology.
