That the Board of Medical Assistance Services shall promulgate emergency regulations to be effective on July 1, 1996, which amend the State Plan for Medical Assistance Services to ensure that the Medical College of Virginia Hospitals Authority created pursuant to this act shall receive disproportionate share payments consistent with the State Plan provisions for Type One hospitals. However, neither the Medical College of Virginia Hospitals nor the Authority shall have the right to bring an appeal or otherwise enforce the requirements of the State Plan for Medical Assistance Services with respect to amounts payable under such payment provisions.
