        That, upon the effective date of this act, the Governor shall transfer the funds and positions presently allocated to license adult care residences within the Department of Social Services to the Department of Health.

        5. That, by October 1, 1996, the Commissioner of Health shall develop, in cooperation with the directors of the Department of Social Services and the Department of Medical Assistance Services, and report to the Joint Commission on Health Care, the Senate Committee on Finance, and the House Committee on Appropriations the plan for implementing the provisions of this act, including staffing requirements, anticipated application processing procedures and times, complaint response procedures and times, and other requirements for maintaining effective and efficient licensure of adult care residences.

        6. That, upon the effective date of this act, all records, whether stored as hard copies or electronically, held by the State Board of Social Services relating to the administration and regulation of licensure of adult care residences, district homes for the aged and adult day care centers shall be transferred to and be held by the State Board of Health.

        7. That all adult care licenses which have been duly issued by the Board of Social Services prior to the effective date of this act shall be deemed, upon the effective date of this act, to have been issued by the Board of Health; further, any disciplinary or investigative actions or applications for licensure which are in progress on the effective date of this act shall become the responsibility of the Board of Health and shall be transferred from the Board of Social Services to the Board of Health.

        8. That the provisions of this act shall be implemented to the extent funds are appropriated therefor.

        9. That this act shall become effective on July 1, 1997.
