SB 997 Motor vehicle, trailer, semitrailer, etc., dealers.

SUMMARY:

Motor vehicle dealers. Separates regulation of “motor vehicle” dealers from “T&M vehicle” (trailers, semitrailers, and motorcycles) dealers; continues regulation of T&M dealers under DMV; vests regulation of motor vehicle dealers in a Board appointed by the Governor and subject to confirmation by the General Assembly; provides for appointment of an executive director and staff for the Board; exempts the Board and its executive director from the State Personnel Act and the Public Procurement Act; generally vests the Board with various regulatory powers hitherto vested in the Commissioner of DMV; changes most penalties for Dealer Act violations from Class 1 misdemeanor penalties to civil penalties up to $1,000; establishes the Motor Vehicle Dealer Fund to cover the costs of the Board's operations; vests in the Board, within certain limits, the power to set the fees for issuance of dealer's license plates.
