SUMMARY:
Capital litigation. Makes the Supreme Court of Virginia the exclusive jurisdiction for filing habeas corpus petitions by a prisoner sentenced to death. The bill also sets time limitations upon the filing of such petitions following appeals to the Virginia and United States Supreme Courts and upon requests for appointed counsel to represent an indigent prisoner sentenced to death in a habeas corpus petition.
The bill also prohibits motions by the Attorney General objecting to appointment of counsel for the petitioner and establishes a procedure for the setting of execution dates.
