SB 940 Sexual assault; sentencing.

SUMMARY:

Sexual assault; sentencing. Provides that any person convicted of more than one of the following offenses is to be sentenced to 20 years for the second offense and shall not be eligible for suspension of sentence: carnal knowledge of a child between 13 and 15 years of age when the offense is committed by a person over the age of 18, carnal knowledge of certain minors, aggravated sexual battery, crimes against nature involving children, adultery or fornication with one's own child or grandchild, taking indecent liberties with a child or conspiracy to commit these offenses. Any person convicted of more than one of the following offenses shall be sentenced to life imprisonment and shall not have any or all of the sentence suspended: rape, forcible sodomy, object sexual penetration, abduction with intent to defile, or conspiracy to commit any of these offenses. Any person convicted under the “three-time loser” statute who was sentenced to life imprisonment without suspension under § 18.2-67.5:3 for commission of more than one designated violent felony sexual assault is not eligible for the old-age exemption to life imprisonment.

This bill is recommended by the Lt. Governor's Sexual Assault Commission.
