SUMMARY:
Power of sale; lien extinguished. Provides that the sale of real estate by an executor or trustee pursuant to a power of sale conferred by will extinguishes any judgment against a devisee as it relates to the real estate. The bill is recommended by the Real Estate Section of the Virginia Bar Association and is a response to a 1993 circuit court decision in Roanoke.
