SUMMARY:

State Child Fatality Review Team. Establishes a 16-member, interdisciplinary team chaired by the Chief Medical Examiner to establish operating procedures for reviewing certain fatalities of children under 18 years of age. Certain information and records relating to a specific child will be accessible to the Team, and records which are periodically purged will be maintained for the longer of 12 months or until the State Child Fatality Review Team has completed its child death review. Strict confidentiality is required, including a signed statement from all persons attending any meeting in which a child's death is discussed. Violations will be punishable as Class 3 misdemeanors ($500 fine). Statistical data may, however, be published. The information and records on specific child deaths will not be subject to the Freedom of Information Act; meetings to discuss such deaths will be closed; and the operating procedures for reviewing child deaths will not be subject to the Administrative Process Act.
