SUMMARY:

Unemployment compensation; substitute teachers. Adds several provisions in the Virginia Unemployment Compensation Act concerning the employment and unemployment status of substitute school teachers in public schools. The amendments provide that the Act's definition of “employment” does not include (i) serving on a temporary, as needed basis when death, illness or other emergency necessitates the temporary absence of the regular teaching staff member, or (ii) being available to be called on an as needed, per diem basis. Moreover, such services performed on an as needed, per diem basis shall be deemed “employment” only if the services are performed in excess of 30 days. The bill also requires claimants who are partially unemployed while ready, willing and able to perform substitute services to report to the Virginia Employment Commission the names of the employers contacted each week in an effort to obtain full-time employment.
