SB 896 Grievance procedures; exempt positions.

SUMMARY:
Grievance procedure for exempted positions. Establishes an expedited grievance procedure for employees in exempted positions who are dismissed improperly. Exempted positions include deputy directors, confidential secretaries, public affairs spokespersons, or policy directors who report directly to the head of an agency with 50 or more employees, if the position is listed as exempt in the appropriations act. Employees in these positions may be terminated for specific grounds, which include poor performance and “Group III” offenses in the Department of Personnel and Training's standards of conduct. Employees in exempted positions who are dismissed may file a grievance, which will be heard by a hearing officer. For complaints not involving dismissal, these employees may utilize the normal grievance procedure. This measure also establishes a defined contribution retirement plan for employees in exempted positions and gubernatorial appointees.
