SB 889 Temporary workers' compensation benefits.

SUMMARY:
Temporary workers' compensation benefits. Permits an employer to initiate temporary workers' compensation payments to an injured worker without an admission of liability under the Workers' Compensation Act. Under the bill, such payments may ensue upon the employer's (or its insurer) sending of a notice of temporary compensation payable to the claimant and the Workers' Compensation Commission. The bill requires the Commission, upon receipt of such notice, to notify the claimant that (i) the payment of temporary compensation does not mean that the employer is accepting responsibility for the injury or that a workers' compensation claim has been filed; (ii) the payment of temporary compensation entitles the claimant to a maximum of six weeks of compensation; and (iii) the claimant must file a claim for benefits in a timely fashion or enter into an agreement with the employer to ensure continuation of compensation payments. An additional notice from the employer to the employee must be given stating that the employee must file a claim for benefits in a timely fashion to ensure continuation of benefits after the six-week period concludes.
