SB 879 Confinement of juveniles.

SUMMARY:

Confinement of juveniles. Clarifies that the court or custodian of a facility may transfer a “dangerous” juvenile to another juvenile facility, or, under certain conditions and if he is 14 or older, to a holding cell or adult jail. The bill also specifies that juveniles ordered into secure detention (upon “arrest” and for a maximum of 72 hours) may be held in a separate court holding cell for up to six hours or in a constantly supervised nonsecure area.

Responsibility for approving local jails to hold juveniles is transferred from the Department of Youth and Family Services to the Department of Corrections. The Departments of Corrections, Youth and Family Services and Criminal Justice Services are to work with the localities and ensure compliance.
