SUMMARY:
Workers' Compensation; fees of attorneys. Amends provisions in the Virginia Workers' Compensation Act requiring health care providers and third party insurance carriers to pay pro rata costs whenever the Workers' Compensation Commission's award on a contested claim benefits such providers or carriers. This bill bases fees paid to the employee's attorney on the amount paid by the employer or carrier to the third party carrier for medical, surgical and hospital services rendered to the employee through the date on which a contested claim is heard before a Deputy Commissioner of the Workers' Compensation Commission. A “contested claim” is defined as an initial contested claim that is subsequently contested and litigated or after abandonment of a defense by the employer or carrier.
