SUMMARY:

Regulation of lead contractors, professionals, and workers. Revises the 1994 provisions relating to certification of lead contractors, professionals, and workers to comply with proposed Environmental Protection Agency (EPA) regulations and, because only proposed federal regulations have been published, to delay the implementation of this requirement from January 1, 1995, to 120 days after the effective date of the Virginia Board for Asbestos Licensing and Lead Certification's initial regulations. The Board's regulations must be finally adopted by October 1, 1995, and will become effective, pursuant to the Administrative Process Act, 30 days later. This bill also adds the requirements for notice and inspection of lead projects which are included in the EPA's proposed regulations. Further, in order to avoid losing a federal housing grant for lead paint abatement, this bill modifies language restricting the Board's regulations to comply with federal requirements and to allow the Board to promulgate regulations which are no more stringent than either the proposed or final EPA regulations, whichever are in place. This bill is a recommendation of the Joint Subcommittee Studying Lead-Based Paint Abatement. The bill contains an emergency clause.
