SUMMARY:
Regulation of insurers. Authorizes the State Corporation Commission to require that a domestic insurer, health services plan, health maintenance organization or legal services plan maintain its principal place of business and its books and records within the geographic limits of the Commonwealth. The bill also amends the definition of “control,” concerning insurance holding companies, to clarify that the relationship between a reciprocal insurer and its designated attorney-in-fact (other than those for reciprocals chartered prior to January 1, 1995) is one of control and, therefore, is presumed to be subject to regulatory oversight as an insurance company holding system. Finally, the bill requires that an insurer which is a member of an insurance company holding system must disclose in its registration statement all cost-sharing and cost allocation arrangements.
