SUMMARY:
Risk-Based Capital Act for Insurers. Creates the Risk-Based Capital Act for Insurers. The Act requires that insurers, including life and health and property and casualty insurers, maintain additional levels of surplus based upon the volume and kinds of insurance transacted. Under the bill, insurers which fail to maintain required levels of risk-based capital will be subject to special corrective action orders issued by the Commission. Mutual assessment property and casualty insurers are not included in the Act's definition of “property and casualty insurer.”
