SUMMARY:
Disposal of vegetation at real estate development sites. Exempts persons depositing trees, brush, or other vegetation from land used for real estate development purposes from the requirement that they obtain a permit from the Waste Management Board. The exemption applies only if the locality has adopted an ordinance for on-site disposal of such waste. A local ordinance must provide that (i) the vegetation is deposited in an area where construction is prohibited, (ii) the site is designated on a recorded plat, (iii) the landowner submit a statement from a professional engineer that the activity does not pose a hazard, (iv) the landowner restrict access to the disposal site, (v) the site be inspected and approved by the local government before it is covered and closed, and (vi) the developer of the real estate agree to maintain the site unless he conveys it to a property owners' association or another entity, and furnish a bond or other satisfactory financial arrangement to the local government ensuring the maintenance of the site for three years. The local government may charge a reasonable fee for the cost of such a program. Depositing unauthorized material in a placement area will be a Class 1 misdemeanor. The Waste Management Board is also required to provide for other reasonable exemptions from permitting requirements for vegetation removed for real estate development purposes.
