SUMMARY:

Records check for firearm purchase. Allows photo-identification forms issued by the United States Department of Defense to be used by prospective purchasers to establish personal identification and residence, and where such photo-identification is used, permanent orders may be used for the additional documentation of residence. When the photo-identification presented to a dealer is a driver's license or other Department of Motor Vehicles ID, and such identification form contains a date of issue, the dealer is prohibited from selling or otherwise transferring a firearm to the prospective purchaser until 60 days after the issue date. An exception to this waiting period is provided where the prospective purchaser also presents a copy of his Virginia Department of Motor Vehicles driver's record showing that the original date of issue was more than 60 days prior to the day of attempted purchase.

A "strawman purchase" for a person the purchaser knows or has reason to believe is ineligible to purchase a firearm, where the violation involves more than one firearm, is punishable as a Class 5 felony (current law) with a mandatory minimum five-year term of imprisonment. Also, a new offense is created to provide the same punishment to the person who solicits, employs or assists another with respect to a "strawman purchase."
