SB 556 Disposal of vegetation at real estate development sites.

Introduced by: H. Russell Potts, Jr. | all patrons    ...    notes | add to my profiles

SUMMARY:

Disposal of vegetation at real estate development sites. Exempts persons depositing trees, brush, or other vegetation from land used for real estate development purposes from the requirement that they obtain a permit from the Waste Management Board. The exemption applies only if the locality has adopted an ordinance for on-site disposal of such waste. A local ordinance must provide that (i) the vegetation is deposited in an area where construction is prohibited, (ii) the site is designated on a recorded plat, (iii) the local government may require a certificate from a professional engineer, (iv) the landowner is required to restrict access to the disposal site, (v) the site must be inspected and approved by the local government before it is covered and closed, and (vi) the developer of the real estate is required to agree to maintain the site unless he conveys it to a homeowners association or another entity, and to furnish a bond or other satisfactory financial arrangement to the local government ensuring the maintenance of the site for three years. The local government may charge a reasonable fee for the cost of such a program. Illegally dumping waste in a vegetation placement site will be a Class 1 misdemeanor. The Waste Management Board is also required to provide for other reasonable exemptions from permitting requirements for vegetation removed for real estate development purposes.
