SUMMARY:
Administrative Process Act; prohibited ex parte contacts. Adds an explicit ban on ex parte communications by interested parties and agency personnel in connection with formal hearings as defined by the Act and the adoption or amendment of regulations. The ban on ex parte communications and requirements for including ex parte communications in the public record of the hearing or regulation process reinforces the provisions of the APA for public record proceedings. The provisions are supplementary to, and do not override, other provisions of basic law or agency regulation which regulate ex parte communications. The bill incorporates a recommendation of the Joint Subcommittee Studying the Report of the Governor's Commission on Campaign Finance Reform, Government Accountability, and Ethics pursuant to SJR 217 (1993).
