SUMMARY:
Programs for voluntary, random testing for controlled substance and alcohol use in public schools. Directs the Board of Education, in consultation with the Office of the Attorney General, to promulgate regulations governing programs for voluntary, random testing for controlled substance and alcohol use by students in public schools. Programs are to be administered by schools on a voluntary basis; consent is required for individual student participation. Fees paid by participating students are to cover program costs to ensure that no state or local funds are expended on these programs. Individual test results are disclosed only to the student and his parent or guardian; comprehensive test results that do not identify individual students shall be available to the participating school and the division superintendent. The Board's regulations are to be promulgated pursuant to the Administrative Process Act and are to include provisions addressing student and parental consent for program participation; confidentiality of test results; agreements between participating schools and companies providing testing, analysis, and data compilation services; and relevant state and federal constitutional concerns. This measure was carried over by the House Education Committee.
