SUMMARY:

Drugs; prohibition of discriminatory wholesale pricing. Requires drug manufacturers to sell their products to all drug wholesalers and retailers on equal pricing terms. Wholesalers are required to accord similar equal treatment to all purchases by retailers. In either case, the bill requires volume discounts to be made available to all on proportionately equal terms. It also prohibits the Commonwealth from purchasing drugs from any manufacturer who violates the terms of this measure. Finally, the bill (i) authorizes a cause of action for violations of its provisions, permitting injured parties to recover treble damages and (ii) subjects persons violating any injunctive orders relating to violations of the bill's provisions to civil penalties not less than $1,000 and not more than $100,000.
