HB 548 Development of water quality standards.

SUMMARY:

Development of water quality standards. Alters the method by which the State Water Control Board (SWCB) develops the most protective form of water quality standard. Water quality standards are those provisions which designate the use or uses for the various water bodies in the Commonwealth and the water quality criteria based upon those uses. If a water quality standard being proposed by the SWCB would result in no new, additional or increased discharge of sewage, industrial waste or other pollutant into a body of water (creating what is known as "tier III" or "exceptional waters"), the proposal is to be submitted to all local governments bordering the section of the water to be affected for review. If a locality, by a majority vote of its legislative body, based on a need to accommodate important economic or social development in the area, or based on an inconsistency with the local comprehensive plan, rejects the standard, the SWCB shall not adopt that standard for that portion of the water body bordering that locality. In addition, the SWCB shall, on its own motion, upon a finding of inconsistency with a local comprehensive plan, not adopt an exceptional water designation for that area.
