SUMMARY:
Public Procurement Act; contract disputes. Allows the "pass-through" of claims on public construction projects. The bill provides that a contractor may (i) submit written notice of his intention to file a claim and (ii) bring suit, in his name or on behalf of his subcontractors or a person furnishing materials for the contract to the contractor, involving a contract dispute with a public body. The bill provides that in a lawsuit, lack of privity between the parties is not a defense, and limits such actions to the recovery of costs and expenses caused by acts or omissions of the public body and not those caused by the contractor.
