SUMMARY:

Fiduciary's failure to file inventory. Allows the commissioner of accounts to issue a summons requiring the appearance of a fiduciary before the court to show cause why the return should not be filed and the fiduciary fined. Under current law, the fiduciary has 30 days after service of the summons (issued by the commissioner, through the sheriff) to file the return; the commissioner must notify the court if the fiduciary does not comply within that time frame. The bill allows the court to impose sanctions ($500 and contempt) on the return date. The bill also modifies the provisions regarding the commissioner's duty to report to the court fiduciaries who have failed to file with the commissioner as required by law. A list of delinquent fiduciaries must be filed monthly with the court, and then the commissioner and the court must promptly proceed with the show-cause hearing.
