HB 2606 Drunk boating.

SUMMARY:

Drunk boating. Denies the privilege of operating a boat for six months and imposes a $500 fine upon any person under the age of 21 who operates a boat with a blood-alcohol concentration of 0.02 to 0.08 (“zero tolerance”). If convicted, such a person is eligible to attend VASAP. The bill also conforms the implied consent provision of the drunk boating law with the drunk driving statutes by removing the blood test option when testing is solely for alcohol intoxication unless the breath test is unavailable or the operator is not physically capable of taking a breath test. That option remains when testing is for the presence of drugs or drugs and alcohol.

This is emergency legislation.
