SUMMARY:
Small claims courts. Provides that a small claims court may be created in any locality upon adoption of a resolution to that effect by the local governing body and subsequent approval by the General Assembly of an act specifically authorizing creation of a small claims court for that locality. Previously, local governing bodies were required to adopt an ordinance prior to General Assembly approval. The bill also adds the counties of Culpeper, Stafford, Lancaster and Albermarle and the City of Hopewell to the list of current jurisdictions (Arlington and Fairfax Counties) authorized to have a small claims division.
