HB 2595 Tobacco use among minors, tobacco purchase, and use.

SUMMARY:

Tobacco use by minors. Clarifies that where any tobacco product is sold from a vending machine, notice is to be placed conspicuously on the machine that purchase or possession of tobacco products by minors is unlawful and the failure to post is made punishable by a civil penalty. The penalties for second violations by minors or vendors are modified to authorize a civil penalty of up to $100 (under current law the penalty is a flat $100). Enhanced penalties are added for third offenses by a vendor, including unposted vending machine (up to $250 civil penalty), while the civil penalty for third or subsequent offenses by a minor remains a civil penalty of up to $100. The bill also provides that cigarettes are only to be sold in sealed packages provided by the manufacturer with the required health warnings.
