SUMMARY:

Correctional facility site selection. Codifies the current practice of developing prison population forecasts by a consensus process and establishes a policy advisory board to review and approve such forecasts. The forecast covers the subsequent 10-year period and is provided annually to the General Assembly. The forecast also includes an estimate of (i) the number of offenders and corresponding security level needs, (ii) the types of facilities needed, and (iii) the number of offenders who may be placed in the Statewide Community-Based Corrections System for State-Responsible Offenders. Mechanisms are created for both the planning and site selection of juvenile and adult correctional facilities. Procedures include notice of the proposed facility to the public, a public hearing on the proposed facility, and, if a locality opposes the site, a resolution opposing the proposed facility adopted by the local governing body.
