SUMMARY:

Drunk boating. Conforms the implied consent and the presumption from alcoholic content provisions of the drunk boating law to those of the drunk driving statutes. Under implied consent the blood test option is removed when testing solely for alcohol intoxication, unless the breath test is unavailable or the driver is not physically capable of taking a breath test. The option remains when testing is for the presence of drugs and alcohol. The presumption language is modified to reflect use of the breath test, making the standard grams of alcohol per 210 liters of breath. This is emergency legislation.
